Storyline

The International Court of Justice (ICJ) today (2 Feb) delivered its Judgment on the preliminary objections raised by Kenya in the case concerning maritime delimitation in the Indian Ocean between Somalia and Kenya, finding that it may proceed with the case.

Somalia brought the case to the Court, complaining that Kenya wrongly claimed parts of its territorial waters, which are potentially rich in oil and gas reserves.

The Court recalled that on 7 April 2009, the parties signed a memorandum of understanding agreeing to grant to each other no-objection in respect of submissions made to the Commission on the Limits of the Continental Shelf (CLCS) on the outer limits of the continental shelf beyond 200 nautical miles.

In its Judgment, which is final and without appeal, the Court by thirteen votes to three, rejected the first preliminary objection raised by the Republic of Kenya in so far as it is based on the memorandum of understanding of 7 April 2009; by fifteen votes to one, rejected the first preliminary objection raised by the Republic of Kenya in so far as it is based on Part XV of the United Nations Convention on the Law of the Sea; by fifteen votes to one, rejected the second preliminary objection raised by the Republic of Kenya; and by thirteen votes to three, found that it has jurisdiction to entertain the application filed by the Federal Republic of Somalia on 28 August 2014 and that the application is admissible.
