“The Committee is not able to conclude that all allegations of serious violations of international human rights law have been investigated. It had no information on investigations in respect of Israel’s actions in the West Bank at the time of the military conflict. It also appears that Israel has refrained from targets as opposed to civilian objects. The Fact-Finding Mission rejected the Israeli viewpoint that the entire governmental infrastructure in the Gaza Strip, including the Legislative Council building, was legitimate target.”

“Israel’s military has acted strongly in accordance with international practice, investigating over 150 separate incidents and allegations. These investigations have led, in some cases, to criminal investigations, indictments and convictions. In other cases, Israel’s Military Advocate General reached the conclusion that Israeli soldiers acted within the law.”

What was said by the general military commander which was what u have said in your report today he is one of those of have planned for the Gaza conflict and assault I cannot understand how can you involve a person who has planned the assault and the criminal act that has been committed against our against in Gaza. All for the continuations of 22 days how can he say that his forces and members of his forces are innocent and therefore we feel that we will be submitting a draft for a resolution before this Council.

Storyline

An independent fact finding committee presented its report titled, "No Safe Place" assessing alleged violations of human rights law and international humanitarian law during “Operation Cast Lead” to members of the UN Human Rights Council earlier today Geneva.

The report by a UN Committee of Independent Experts into domestic investigations into the 2008-9 conflict in Gaza and southern Israel, highlighted continuing failures of both the Israeli and Hamas authorities to investigate violations of international law that were documented more than a year ago by a UN fact-finding mission headed by Judge Richard Goldstone.

Chairman of the Expert Committee Christian Tomuschat said that “the Committee is not able to conclude that all allegations of serious violations of international human rights law have been investigated.”

Israeli Ambassador Aharon Leshno Yaar said that “Israel’s military has acted strongly in accordance with international practice, investigating over 150 separate incidents and allegations.” He added that “Israel’s Military Advocate General reached the conclusion that Israeli soldiers acted within the law.”

Palestinian Ambassador Ibrahim Khraishi said that said that the Palestinian authorities will be submitting “a draft for a resolution before the Council” relating to the findings of the report.

The report concluded that the domestic investigations carried out by both the Israeli government and the Hamas de facto administration in Gaza into alleged violations of international law committed by both sides have failed to meet the required international standards of independence, impartiality, thoroughness, effectiveness and promptness.
