This is consistent with the findings of the AU High-Level Panel, which found ‘faith in the criminal justice system has been severely eroded’, and with the findings of others.”

The United Nations Security Council today heard a statement on Sudan from the International Criminal Court’s (ICC) Prosecutor Luis Moreno-Ocampo.
Moreno-Ocampo said that while the government of Sudan had the primary responsibility and was fully able to implement the warrants issued by the Court against Ahmad Harun and Ali Kushayb, it had not done so. And, he said, the judges had taken steps to make a decision and notify the Council.
Moreno said that he wished he could say that the situation in Darfur had improved but, “sadly, the truth was that the attacks against civilians not participating in the conflict continued.”
The prosecutor said that in February, immediately after the signing of a peace agreement and public commitments to peace, 100,000 civilians were forcibly displaced by Sudanese armed forces in the Jebel Marra.
He added that the ‘modus operandi’ was the same as the one used by Ahmad Harun in the 2005 air bombardments followed by attacks of Sudanese Janjaweed militia.

Moreno Ocampo stressed that gender crimes remained “unabated in Darfur” and noted that even of greater concern were the findings of the independent expert on the situation of human rights in Sudan justice Mohammed Chande Othman, who found that victims were increasingly discouraged from reporting rape and sexual violence, “because they know they won’t benefit from remedial action.”
In its investigation, the ICC had issued arrest warrants for three individuals for war crimes and crimes against humanity. In April 2007, the court issued warrants for Ahmed Haroun, then the country's minister for humanitarian affairs and now governor of Southern Kordofan state, and Ali Kosheib, whose real name is Ali Mohammed Ali, a "Janjaweed" militia leader.
Moreno told the council that the impunity of Ahmad Harun, currently the Giovernor of South Kordofan, and of tribal leader Ali Kushayb was one of the main problems and that it carried a price.
