"The United States’ failure to shut down the Guantanamo detention centre has been an example of the struggle against terrorism failing to uphold human rights, among them the right to a fair trial. Allegedly, more than half of the 166 detainees still being held in detention have been cleared for transfer to either home countries or third countries for resettlement, yet they remain in detention at Guantanamo Bay. Others reportedly have been designated for indefinite detention."

"I have repeatedly urged the Government of the United States of America to close Guantanamo Bay in compliance with its obligations under international human rights law. I encourage the United States to ensure that all such measures are carried out in compliance with its obligations under international human rights law."

"I urge all States to be completely transparent regarding criteria for deploying drone strikes, and to ensure that their use complies fully with relevant international law. Where violations do occur, States should conduct independent, impartial, prompt and effective investigations, and provide victims with an effective remedy."

The United Nations High Commissioner for Human Rights yesterday reiterated its call for the United States government to close the Guantanamo Bay detention centre in compliance with its obligations under international law.
In her opening address to the Human Rights Council in Geneva on Monday (27 May), Navi Pillay described the United States' failure to shut down the Guantanamo detention centre as an example of the struggle against terrorism failing to uphold human rights, including the right to a fair trial.
Pillay said that allegedly more than half of the 166 detainees in Guantanamo had been cleared for transfer to home countries or to third countries for resettlement. Others reportedly have been designated for indefinite detention.
Instead of fighting terrorism the High Commissioner asserted, the injustice embodied in such arbitrary detention had become an ideal recruitment tool for terrorists.
Pillay acknowledged President Obama's statement outlining practical steps to close the detention facility.
Pillay encouraged the United States to ensure that such measures are carried out in compliance with its obligations under international human rights law.
In a wide-ranging statement, Pillay said she was profoundly disturbed at the human rights implications of the use of armed drones in the context of counter-terrorism and military operations.
She said an increasing number of states were seeking to acquire such weapons.

When violations occur, the human rights High Commissioner said states should conduct independent, prompt and effective investigations and provide effective remedy for victims.
