The International Court of Justice (ICJ) said Wednesday(19 Apr) the conditions to impose provisional measures against the Russian Federation were not met in a case brought against it by Ukraine in which Ukraine alleged Russian support to separatists in the eastern part of the country.

The ICJ said Ukraine had not presented evidence that the intention and knowledge, as well as the element of purpose, to support terrorism were present to rule on provisional measures which would be taken as the Court heard the case, while observing that the acts referred to by Ukraine have given rise to the death and injury of a large number of civilians.

The Court did however find that Russia must refrain from imposing limitations on the ability of the Crimean Tatar community to conserve its representative institutions, including the Mejlis which was banned last year, and ensure the availability of education in the Ukrainian language in Crimea. It also concluded that both Ukraine and Russia shall refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve.
